The Pakistani MIT graduate accused of firing two shots at an Army captain while being detained on suspicion of terrorist activities in Afghanistan failed to show up for her arraignment in federal court in Manhattan yesterday due to poor health, her attorney said.
The attorney for Aafia Siddiqui, 36, said her client, who is suffering from a gunshot wound, isn't well enough to come to court. Elizabeth M. Fink asked that Siddiqui be arraigned at the Metropolitan Detention Center in Brooklyn, where she is being housed, and hospitalized.
Charges against her include attempted murder of a U.S. official, assault and illegal use of a firearm.
'She's a mess, judge, and she has to be rehabilitated,' said Fink, who asked that Siddiqui be transferred to Bellevue Hospital Center.

SAN FRANCISCO, Sept 5 (Reuters) - The vote of the European Union's second highest court last year to uphold a European Commission ruling against Microsoft Corp (MSFT.O: Quote, Profile, Research, Stock Buzz) came on a 7-6 vote, Bloomberg news reported on Friday.

The Court of First Instance never announces its votes, but Bloomberg said two people with direct knowledge of the outcome confirmed the vote.

On Sept. 17, 2007, the court in Luxembourg upheld the 2004 finding of the European Commission that Microsoft had violated antitrust laws, for which it was fined 497 million euros and ordered to change its business practices
