Arbeau said it was not often that such a substantial shipment is discovered.

Stanley Wagner and Raymond Wolff are members of America's Greatest Generation.
It's a distinction they've earned in part because they lived through many of our nation's darkest hours-including the Great Depression.
'For a while, everyone ... just didn't know what to do, didn't know what's going to happen,' Wagner said. 'And they thought it was almost the end of the world then.'
Both men now live at the McCarthy Court Senior Living Apartments in New Bern.
And both men were born before the big stock market bust in October 1929.
Stanley was born in 1923-Raymond in 1918.
Although they were both young then, they still saw plenty of hardships as the depression dragged on in to the '30s.

PERTH, Australia (AFP) Passengers told Wednesday of their terror as a Qantas jet plunged dramatically in mid-flight, slamming them against the cabin roof, breaking bones and causing spinal injuries.
Police said 36 passengers and crew were injured, 20 seriously, when the Australian Airbus A330-300 flying from Singapore to Perth suddenly dropped thousands of feet in just a few seconds on Tuesday, forcing an emergency landing.
'It was horrendous, absolutely gruesome, terrible, the worst experience of my life,' said Jim Ford, of Perth, who said he thought he was going to die when he saw his fellow passengers being flung around the cabin.
Several passengers said the plane had fallen around 2,000 metres (yards) while cruising over the Indian Ocean, hurling people and objects around.
Qantas described the incident as a 'sudden change in altitude.'
'Passengers and crew not wearing seatbelts were flung around in the plane, some hit the ceiling,' said Nigel Court, who was among the 303 passengers on board the jet.
Video footage showed smashed ceiling panels in the plane that made an emergency landing at an air force base near Exmouth in remote Western Australia after the incident that reports said could have been caused by turbulence.
News pictures showed passengers being taken off the jet by emergency services on stretchers and in wheelchairs.
Around a dozen of the injured were flown to Perth for treatment, while Qantas planes were sent to pick up the remaining passengers.
'Basically the plane just fell out of the sky,' one passenger told Sky News. 'It must have lasted 10 or 12 seconds, it just went straight down,' he said

The unidentified student is charged with Disturbing Schools.
Acting on a tip from a student, deputies and officers responded to the school and removed the teenager from class. The student, earlier in the day, displayed the firearm in his waistband during physical education class.
The student will be held at the South Carolina Department of Juvenile Justice, in Columbia. He will appear in Aiken County Family Court either Wednesday or Thursday.

A former Rocky Mountain College chaplain has been convicted in Lawrence, Kan., of aggravated indecent liberties with a child.Christopher L. Cormack, 38, was convicted Monday after a jury trial in Douglas County District Court and is free on bond.He plans to appeal the conviction after sentencing, which is set for Nov. 25, his attorney, John Kerns, said Tuesday.Cormack could be sentenced to from 55 months to more than 19 years in prison for the conviction.

In a hearing at the U.S. Court for the Southern District in Texas, Judge Andrew S. Hanen heard both sides present their views on damages in the case, then told them to try to resolve the issue.

'It's time to set things aside or to bury the hatchet and to start to negotiate.' Hanen said. 'And if there is anything I can do to promote this, I am at your disposal.'

Hanen ruled in August that Grupo Mexico, which is Asarco's parent, had made a 'fraudulent transfer' of Asarco's stake in Southern Peru Copper Corp and harmed Asarco creditors in the transaction.

The two sides have widely differing views on appropriate damages in the case, with Asarco requesting about $7 billion, and Grupo Mexico arguing for between $50 million and $100 million

The 54-year-old was previously convicted and sentenced to death during a high-profile case in 2005. Due to pretrial publicity, the case was moved from Marion to Sumter County.
However, last June the Florida Supreme Court vacated the conviction and ordered a new trial based on a technicality during jury selection.
Kopsho's lawyer, Chief Assistant Public Defender Bill Miller, expressed somber relief at the judge's decision to continue the case.
'I know I've got a lot more work to do in the next four months,' he said. 'I don't make those motions lightly.'
As he told the court Tuesday, Miller was concerned about the narrow window of time he had in which to depose the new witness, Debra Dahlen Kopsho's first wife and a person who Miller said 'could put my client in a death chamber.'
Prosecutors plan to use Dahlen to rebut statements Kopsho made to psychologist Elizabeth McMahon that suggest he was victimized by all his former wives, of whom there were five, because they either cheated on him or left him.
That was Kopsho's only real shot at mitigating evidence, prosecutors said Tuesday

The 74th amendment (that defines the domain of urban civic bodies) gave more power to civic bodies but somehow or the other the resource base did not increase, said Mehra.
Eminent Supreme Court lawyer Pinki Anand, who was also present, emphasized that the 74th amendment had not become fully operational because the powers had not been directly divested in local bodies.
They are still with the state government. The states have not done enough to devolve sufficient powers to local bodies. Vital issues like Town Planning and Urban Planning are dealt with by state governments at their own level without involving local bodies.

Research by Demos and our partners reveals that, even 15 years after the law was passed, many states are failing in their responsibility to adequately implement the NVRA s agency-based registration requirement. While the law s motor voter provision is widely implemented and well-known, this other -- known as Section 7 of the law -- has been long ignored.
Several states, however, have seen enormous progress in the past months in providing low-income citizens the opportunity to register. Thanks to the bold actions and dedication of election and public assistance officials in North Carolina, Michigan, and Virginia, as well as a recent court order in Missouri, tens of thousands of low-income voters now have an opportunity to participate in the upcoming election.

Urban sold 30 billion yen worth of bonds to BNP Paribas but the French bank was repaid that 30 billion yen as a deposit. BNP Paribas was then only required to give that money back to Urban gradually based on the level of its share price.

The lower the stock price the less money Urban would be paid.

Urban's stock slid 70 percent between July 11, when the swap was put into action, and Aug. 13, when it filed for court protection from creditors. During that time Urban did not reveal the swap portion of the deal.

A man has pleaded guilty to the murder of Finbar Dennehy who was found dead in his apartment in Clontarf in Dublin last year.

At the Central Criminal Court 42-year-old Michael Downes, of no fixed abode, pleaded guilty to the murder of 50-year-old Mr Dennehy some time between 24 September and 26 September last year.

Mr Dennehy, a retired business executive, died from a single stab wound.

KIRKSVILLE, Mo. -- A north-central Missouri teenager is accused of trying to poison his grandmother about two weeks before she died in a car crash.
Adair County Circuit Court documents show 18-year-old Robert William Sapp of Gibbs was arrested Friday and charged with attempted murder. He was accused of putting antifungal spray into the coffee of his grandmother, 74-year-old Wilma Kelsey.
Kelsey had filed a complaint with the sheriff's department in early September. On Sept. 17, Kelsey died when the car she was driving on U.S. 63 crossed the median and hit a truck head-on.
According to court documents, Sapp told police he wanted his grandparents dead because they were rude and were always telling him what to do

He was arrested the same day - June 11 - hiding under a quilt in a flat near his own. He was aggressive, gave false details and did not co-operate with a police search. He was taken to hospital where a package containing three wraps of heroin was retrieved from his body. Two more wraps were found in his home.
Two days later in court, on finding out he would not be given bail, he briefly attacked a dock officer, grabbing hold of his throat.
Wood, of Westbourne Road, Redcar, admitted possessing an offensive weapon, possessing a Class A drug with intent to supply, obstructing a PC and common assault.
The offences were in breach of a one-year suspended sentence imposed in March for burglaries and other crimes.
David Lamb, defending, said Wood dealt to support his own habit. References from his girlfriend and mother said he was nice, kind and polite.
Judge Les Spittle jailed Wood for a total of three years and nine months, activating the one-year sentence from March, plus two-and-a-half years for the drugs and knife offences and three months for the assault in court

The carrier will seek court protection from its creditors to enable it to continue operating while it undergoes a radical restructuring.
Plans are being drawn up to split the carrier into two and to sell a stake in a new entity to a foreign airline.
Losing 1m euros a day, Alitalia has survived on a 300m-euro state loan.

Guaranteeing the airline's future will depend on securing fresh investment and persuading its unions to accept large job cuts.
Both Air France KLM and Lufthansa have expressed interest in investing in any new entity which emerges from the current business.
According to Corrado Passera, head of the airline's financial advisers Intesa Sanpaolo, Alitalia's board drew up a request to seek bankruptcy protection on Friday.
This would give the firm breathing space to reach agreement on how the business can proceed.
Future plans for the carrier would see it divided in half, with its loss-making operations remaining under bankruptcy protection.
Profitable short-haul routes would be hived off to a new business, controlled by a consortium of Italian investors including budget airline Air One which would effectively be merged with Alitalia.
Italian ownership
Prime Minister Silvio Berlusconi has made Alitalia's continued ownership by Italian interests a precondition of any rescue deal.
However, experts have said the airline can only survive in the future as part of some European alliance.
Previous attempts to sell the business to a foreign airline have foundered over union concerns about job losses and unease over the severity of the airline's financial problems.
The airline's perilous position was put into perspective by Roberto Colaninno, appointed to take charge of the new entity that emerges from the restructuring.
'No one can buy Alitalia in the state it's in,' he told La Repubblica newspaper.
'With all respect, I am not Merlin the magician. The business is toast. It doesn't exist any more. There's nothing left.'
Alitalia has been crippled in recent years by strategic indecision, poor industrial relations and soaring fuel costs.
Its shares were suspended earlier this summer while the firm has delayed the release of its 2007 accounts.

The Jamaica Gleaner newspaper reported that the police have solved fewer than half of the murders of children since 2003, according to data from the Jamaica Constabulary Force (JCF). The data revealed that, of 398 murders of children up to 17 years old, only 195 have been cleared up. Likewise, the Gleaner reported, of 441 incidents of shootings that left children injured, only in 116 cases have the perpetrators been caught.. Susan Goffe, Director of Jamaicans for Justice said, What is clear is that people know they can commit murders and have a very strong chance of getting away with it. The JCF houses the Centre for Investigation of Sexual Offences and Child Abuse and an Office of the Children's Advocate and Children's Registry were established under the 2004 legislation, but Macaulay suggests that a joint unit is needed. She also said that the legal structure of the Family Court, is archaic and intimidates children, and calls for the updating of supporting legislation particularly the Incest Punishment Act

Police allege Victor Anthony Wheat used deceit to have sex with a call girl in her East Perth apartment in August.
It is alleged he paid for the all-night service with a $10,000 cheque he knew would bounce because of insufficent funds in his bank account.
He is also accused of attempted fraud in relation to a police sting operation involving another prostitute last month.
Today his lawyer told the court the allegations were unusual and Mr Wheat intended to plead not guilty.
The case was adjourned until the 21st of October

Senior Jessica Giuggioli led MU by winning the top singles division over Louisville's Jo-Ann Van Aerde in a grueling three-set match.

Taking the court at 10 a.m. Sunday, Giuggioli dropped the first set 1-6.

'I started off really slow,' Giuggioli said.

But she stormed back to take the second set, 6-3. In the third, Giuggioli had to overcome a slew of double faults and a few arguments with the line judge to stay in the match.

'I was really frustrated, but I just tried to keep my head and not let it get to me,' Giuggioli said.

Still, she was able to force a tiebreaker

Oren Shur, the spokesman for Jay Nixon, the Democratic candidate for governor and current attorney general, said Hulshof's announcement is a character attack from a congressman who is down in the polls and is starting to panic.

The firefighters' lawsuit in San Diego County Superior Court sought unspecified compensation from the city.
The firefighters claimed they were humiliated by taunts and sexual gestures from parade watchers. Their complaint said that parade participants included 'a group of radical homosexual men' dressed in nun habits and others who yelled comments such as, 'You're making me hot!' and, 'I can't breathe, give me mouth to mouth!'

PORTLAND - A Portland State University student was arrested Monday morning for trying to burn down a campus dormitory.
Fire crews were called to St. Helens Court just before 4:30 a.m. to find a pile of bundled newspapers and phonebooks that had been burned in a stairwell. Students managed to put out the fire by the time crews got there, Lieutenant Allen Oswalt said.

A Bethalto man was beaten to death with a wood-splitting maul Sunday night, and authorities have charged his son with the slaying.
James Lane, 33, of 125 Thompson, Apt. 32, has been charged with first-degree murder and aggravated battery in the beating death of his father, James R. Lane, 63, of 7311 Harris Court in Bethalto.

Yeh was indicted on Aug. 28 on suspicion of concealing government documents containing a list of overseas bank accounts in the names of members of Chens family and leaking national secrets. Naek, who met Sarabjit at the Kot Lakhpat prison in the first contact by a Pakistani minister after the new PPP-led coalition Government assumed office in March, said he had sought the 42-year-old Indians file from the jail superintendent so that he could study his case.
The Supreme Court had dismissed Sarabjits mercy petition. After the Supreme Courts decision, only the President has the powers under Article 45 of the Constitution to pardon or remit his sentence. No one else can do this, Naek told reporters outside the prison.

Two analysts cited changes the Internal Revenue Service has made in the tax treatment of losses when a bank is purchased, allowing acquiring banks to recognize tax benefits on loan write-downs at targets as immediate tax benefits, rather than recognizing these benefits over many years.
That could make a Wells Fargo takeover of Wachovia costly to the government in terms of tax revenue.
On Sunday, Citi said it won a court order blocking Wells Fargo from buying Wachovia. That was the first step in a weekend of legal wrangling in state and federal courts as Citi tried to protect its initial agreement.
People familiar with the matter said Sunday that the U.S. Federal Reserve was brokering discussions between Wells and Citi over which bank would buy Wachovia's assets.
The Wall Street Journal reported the Fed was pushing the two banks to compromise by potentially carving up Wachovia between them

MULTAN: Two groups of lawyers clashed due to objection raised by office bearers of the bar upon arrival of Attorney General of Pakistan Sardar Latif Khosa at Multan High Court Bar forcing the AGP to leave for Lahore
According to details, Bar Association of Multan had banned Sardar Latif Khosas entry in Multan High Court Bar yet he arrived at High Court Bar accompanied by ex-President High Court Bar Association Habib Ullah Shakir, Nasir Haideri, Arif Alvi, Rana Javed and other lawyers belonging to Peoples Lawyers Forum where many other lawyers warmly welcomed them and had tea.
Meanwhile Secretary Bar, Rana Naveed and some other lawyers objected to Khosas presence there and ask him to leave. Senior lawyers like Sahibzada Farooq Ali Khan, Malik Haider Usman, Mian Abbas and others tried to convince them but Bar Office Bearers started to chant slogans and a quarrel started between both groups. A second man was arrested on Monday in connection with an alleged assault on former Celtic captain Neil Lennon.
Police detained the 43-year-old over the alleged attack on the footballer in Glasgow on September 1.
The incident happened hours after Lennon was in the Celtic dugout during his club's 4-2 home defeat to Rangers.
Lennon, now a coach at Parkhead, was treated for injuries following the incident in the city's Ashton Lane just after midnight.
Strathclyde Police said the man was in police custody and will appear at Glasgow Sheriff Court on Tuesday.
A report is being sent to the procurator fiscal.
Monday's arrest comes after another man was charged over the incident.
David Whitelaw, 46, faced a charge of assault to severe injury when he appeared in court on September 25

Citigroup's announcement was the latest twist after a frenzied weekend of legal developments surrounding the battle for the takeover of Wachovia.
After an apparent agreement with Citigroup last week for a 2.16 billion dollar takeover, Wachovia on October 3 suddenly pulled out of the deal, announcing that instead it would favour a 15-billion-dollar merger offer by Wells Fargo & Co.
Under a ruling by US District Court justice John G. Koeltl, a hearing on whether Wachovia and Wells Fargo can go ahead and negotiate their merger agreement was postponed until Tuesday.
Earlier Monday, Wall Street Journal, citing people familiar with the situation, reported that a possible compromise in the takeover battle was in the making, with Citigroup Inc. and Wells Fargo & Co. considering a deal to divide up the the bank.
The newspaper said the two banks, with officials of the Federal Reserve and the US Treasury Department also involved, were discussing this scenario to end their takeover battle which in turn was disrupting a federal rescue of Wachovia.
Under the scenario of a split up of Wachovia, Citigroup would get the bank's branches in the north-eastern US and mid-Atlantic regions

Lee O. Koenig, was sentenced Monday morning for a term of not less than 19 years and not more than 20 at the Nebraska Correctional Center in Lincoln for the Nov. 17, 1007 fatal shooting of Russell Christiansen of Wahoo.
In August, Koenig stood in Saunders County District Court and, through an agreement with the prosecution, pled guilty to manslaughter. In exchange for his guilty plea, the charge of a felon in possession of a firearm was dropped. He had been previously convicted on federal drug charges.
Koenig will have to serve at least 9 1/2 years of this current conviction before being eligible for parole. He was given credit for 324 days already served in jail.
Koenig was arrested the same day that the shooting took place on acreage near Yutan.
Following the shooting, Koenig told law enforcement officials that he was aware that Christiansen and his son were hunting on the acreage

Rodney Carney opened the second quarter demonstrating his famed hops with a soaring tomahawk jam as he blew past Rafael Araujo. Less than two minutes into the quarter, Miller brought the White team back to a 27-27 tie with a 26-foot three pointer, but the White team could not hold onto the lead as the black team went on an 8-3 run to reclaim a 35-30 advantage with 2:00 to go in the half.
The Black team closed out the half strong after two transition buckets from Corey Brewer to extend the lead and take a 39-32 lead into the locker room. McCants led all scorers after one half with 14 points for the Black team on 4-of-10 shooting, while Mike Miller led the White team with 12 points on 4-of-8 shooting.
The White team opened up the second half with a steady comeback, cutting the lead to two points, but Black responded with a couple fast break baskets to pull away to a 51-41 lead with 1:30 to go in the abbreviated, eight-minute third quarter. After a couple of White team free throws and a Blake Ahearn three-pointer, Black took an extended 54-46 lead into the final period.
The final quarter was pared down to seven minutes and White came out with a sense of urgency, quickly trimming the deficit to three points 80 seconds in. White clawed their way back to an even 55-55 score off a three-quarter court outlet pass from Kevin Love to Randy Foye for an easy bucket. After Ahearn and Foye traded threes, Craig Smith had a put-back basket for the Black team to reclaim the lead at 60-58 with 2:35 remaining. With the score tied at 62-62 and :20 remaining, the White team took control of possession, Randy Foye dished to Kevin Ollie in the left corner for a wide open jumper that hit front rim, and the Timberwolves scrimmage ended in a draw.

We do already have in place systems which ensure accountability and transparency at even the highest levels of the courts structure; the duty to give reasons, the appellate and review systems, as well as the systems for complaints are all recognised methods of accountability, she said.
Mrs Wood expressed the hope that the service would deepen these democratic values through the pursuit of accountability and integrity in enhancing initiatives.
As we prepare for the December 2008 national elections, it has become increasingly clear that a truly impartial and independent, effective judiciary is sine qua non for national peace and stability, she said

Without question, the deal was far sweeter for both Wachovia shareholders and taxpayers. For the first time in recent memory, free markets triumphed, whoo-hoo!
Good news, right? In a perfect world, yes, but our markets are more like something between a soap opera and a science-fiction novel, so you know this story gets better.
Free markets, meet free courts On Saturday, a group of Citigroup lawyers visited a New York judge at his house, persuading him to temporarily block the pending Wells Fargo transaction because Citi had an 'exclusivity agreement' that prevented Wachovia from striking a deal with anyone else.
Then last night, the jesters kicked it into high gear, with that ruling being overturned by a New York State appellate court. Not surprisingly, Citigroup says it intends to appeal the ruling and around and around we go.
What should irk you -- the taxpayer -- is that Wells Fargo's offer didn't include any government backstop, as Citi's offer did. From that standpoint alone, you'd think Wells Fargo's offer would have been ushered in by regulators, yet it was (at least temporarily) shot down by the courts. Perhaps bailouts have become so commonplace that no one knows how to handle a deal without one.
All of this just for Wachovia? Why Citi and Wells Fargo are fighting so viciously isn't much of a surprise; Citigroup's drooling over Wachovia's $400 billion deposit base, which it can use as a cheap source of funding in lieu of short-term debt markets that have practically disintegrated

Clinton company wins another spam lawsuit CLINTON -- A Clinton-based Internet service provider has been awarded a more than $236 million federal judgment against an illegal spammer. Robert W. Kramer III, owner and operator of CIS Internet Services, filed the lawsuit against defendants Henry Perez and Suzanne Bartok of Arizona in December 2004. A federal judge in U.S. District Court in Davenport found that Perez and Bartok, who are husband and wife, sent more than 23 million e-mails advertising loan refinancing services to CIS computers in 2003. Under the judgement, the couple were held personally liable and not protected by the limited liability of their corporation. Kramer says he hopes the ruling sends the message that spamming isn't tolerated. In January 2006, Kramer was awarded an $11.2 billion judgment against a Miami spammer. He also earned a total of more than $1 billion in a judgments against three other spammers in 2005. LONDON (AP) - A court has suspended the license of a truck driver who careened down a highway while watching episodes of 'Battlestar Galactica' on a laptop computer atop his dashboard.Police say Benjamin Trotman drove for 25 miles (40 kilometers) in northern England last December with one eye on the road and the other on the cult sci-fi show. A traffic officer who pulled him over found the show still playing on his computer.Trotman's lawyer claimed he had been looking at Google Maps while listening to the sound from the show. But Trotman pleaded guilty to dangerous driving at an earlier hearing.On Friday a justice of the peace banned him from driving for 15 months. He also was sentenced to 225 hours of community service and ordered to pay 546 pounds (US$970) in costs.

Corsham mum given another chance after theft

A mum who stole more than 16,000 from her parents has been given another chance after failing to do any community service.
Cindy Clifford was put on a six month suspended sentence and told to do 240 hours of unpaid work.
But since the order was passed in May the 27-year-old hasnt done any of the community service and even had seven hours added to it in August.
Now a judge at Swindon crown court has given her a last chance to get on with the work or serve the jail term.
Judge William Hart told her For a third breach it is almost inevitable a judge will impose the sentence.
Instead he allowed the order to continue and put her on a three month supervision order with probation.
Earlier he had been told within days of the seven hours being added to the order in the summer her grandmother, who she was very close to, died.
Over the following weeks she then failed to turn up and keep appointments burying her head in the sand.
Clifford stole cash and jewellery from the family home before taking her mothers chequebook to fund her and her boyfriends drug habits and pay for a luxury holiday

Mr Tobin, a 35-year-old mechanic from Mottingham, south-east London, died in a split-second when he was shot near Warwick Services on August 12 last year.
Mr Raggatt said: 'The incident was a thoroughly ruthless one executed with great skill and precision, great timing... and was the product of a great deal of planning.
'It was a thoroughly carefully aimed shot delivered by someone in a vehicle.
'It was a moving vehicle travelling at something like 85 to 90mph, approaching carefully from behind.'
The jury of six men and six women at Birmingham Crown Court that was told that Mr Tobin, who was travelling in convoy with two other motorcycles returning from a Hell's Angels music festival, was targeted not because of who he was but because of what he was.
The car from which the fatal shot was fired was found burnt out on the same day, rendering it forensically useless, Mr Raggatt added.
Addressing the motive for the crime, Mr Raggatt told the jury: 'This wasn't a case of a man being killed for any personal motive or any personal reason.
'This was a man who was targeted not because of who he was, but because of what he was. In one sense, Gerry Tobin was a random victim.'
Describing the killing as a conspiracy which was put into effect with determined efficiency, Mr Raggatt continued: 'There was contingencies and alternatives that had been planned for.
'It was in that sense almost a military-style operation and had at its heart the plain intention to kill.'

Can a company be held liable for failing to deliver on promises made during a job interview?
One former Dechert associate thinks so and has filed suit against the firm claiming it exaggerated the extent of its corporate work in order to woo him, did not provide the touted opportunities, and then fired him in part because he is an Orthodox Jew.
In his complaint - filed in New York trial court by attorney Neil Brickman - the ex-Dechert associate, Marc Lubin, says he has worked at four top 100 US law firms since graduating from Columbia Law School in 1994. Dechert was the last of those firms; Lubin jumped there from Skadden Arps Slate Meagher - Flom in October 2002 because, according to the complaint, he felt 'he should be gaining greater experience in a wider variety of structured finance deals'.
Lubin says Dechert, especially partner Malcolm Dorris, told him during interviews that he would participate in endless transactional work with major clients.
Lubin's suit says that when he decided to take the Dechert job, he spurned two other offers - including one from 'an international bank' - and took a 20% pay cut from his $215,000 (119,000) Skadden salary

The State Government has changed its policy in order to get children out of police stations. The problem arose because the Children's Court is not open to hear child custody cases after 3pm. Children removed from their parents late in the afternoon were usually taken to police stations to wait for bail justices to hear DHS requests for emergency foster care. Biker Gerry Tobin shot in 'military style operation', court heard

A MOTORCYCLIST was shot dead by a revolver fired from a car as he sped along a Midland motorway in a 'military style operation,' a court heard today.
Gerry Tobin, aged 35, who died in a split second was 'targeted' not because of who he was but because of what he represented, it has been alleged.
Malcolm Bull, 53, from Milton Keynes, Ian Cameron, 46, of no fixed address, Simon Turner, 41, from Nuneaton, Karl Garside, 45, his brother Dane Garside, 42, and Dean Taylor, 46, all from Coventry, have all denied a charge of murder and possessing two shotguns.
Turner and Dane Garside have also pleaded not guilty to possessing a firearm with intent.
Timothy Raggatt, prosecuting at Birmingham Crown Court, said the incident happened on a sunny Sunday afternoon, August 12 last year, on the M40 near Warwick Services.
'The incident was, you may come to think, thoroughly ruthless, executed with great skill, precision and great timing and ultimately the product of a great deal of planning and attention to detail,' he said

The Queensland Government had no option but to go down the path of developing race fields legislation, following the breakdown of the gentlemans agreement, to ensure the Queensland racing industry is not out of pocket.
Without such changes, the Queensland racing industry risks losing several million dollars per year to NSW alone.
The Government will be recommending that Parliament makes the operation of the Bill retrospective to 1 September 2008 in line with the operation of the New South Wales legislation.
It is expected that other States will introduce race fields legislation in the near future, with South Australia already indicating that its legislation will also apply retrospectively.
In making its decision, Mr Fraser said the Queensland Government was mindful of the recent High Court decision in the relation to the Betfair v West Australian Government case.
It is important that any legislation does not discriminate against operators on a geographical basis. All wagering operators, whether based in Queensland or licensed elsewhere in Australia, will be required to gain approval to offer betting on Queensland races.
Mr Fraser said he expected the Bill to be introduced into Parliament before the end of the year.
The amendments to the Racing Act will allow the Queensland racing control bodies Queensland Racing Limited, Queensland Harness Racing Limited and Greyhounds Queensland Limited to charge wagering operators a turnover-based fee for using Queensland racing product.
The amount of the fee will be determined by the Queensland racing industry, not the Government, as the money will go directly back to the industry, Mr Fraser said.
NSW has determined that a fee of up to 1.5% on wagering turnover is an appropriate charge

Actually, the residency requirement in Huntington goes back to 1965, when it was added to the city charter by the voters.
It was approved again by the voters when the city adopted the strong mayor form of government.
Huntington City Council brought the issue up again about six years ago when it enacted an ordinance saying that if you are going to work for the city and you were hired after 2002, you're going to have to live in the city or face dismissal.
Mayor David Felinton vetoed the ordinance, but council overrode the veto. He believes it hurts recruiting efforts, and notes that the number of applicants taking civil service exams since 2002 has decreased substantially.
The residency requirement has been to the state Supreme Court five times since 1983.
In 1993, a circuit court judge stopped the city from enforcing the requirement until it could figure out how to do it uniformly.
It remained unenforced until council enacted the new ordinance in 2002.
The latest attack on the residency requirement wound up in the state Supreme Court again, where last week the court ruled that it doesn't violate employees' right to due process.
That means, the court said, that those employees who don't provide proof they live in the city must be given a due process hearing, but may be fired if they can't provide proof of residency.
No one is sure how all this is going to play out

'Cheshire Constabulary is committed to the partnership work that is needed to ensure victims are safe.
'The police have a vital role to play in responding to calls and in holding perpetrators to account but the involvement of many other agencies is vital to keeping victims safe.'
MARAC is chaired by police and co-ordinated by managers of Domestic Abuse Family Safety Units commissioned by the partnership and employed through Cheshire County Council to support vulnerable families.
It has been in place in West Cheshire since April 2007 and East Cheshire since October 2007.
The partnership brings together all frontline services including police, health, social care, education, housing, probation, CPS, local authorities, community safety partnerships, refuges, Victim Support, NSPCC and Domestic Abuse Family Safety Units.
Advocates within the units particularly support victims acting as witnesses in court cases. Cheshire has two Specialist Domestic Violence Courts in Crewe and Chester.
One victim said: 'At the court I felt supported and just having that person there to believe in you makes a whole lot of difference.'

It's only fair to post on the scoreboard the summary of each play that gets announced to the crowd--in fact, the scoreboard version is sometimes easier to understand than the announced version, even for hearing fans.
But the songs played during time-outs and halftime are hardly crucial to an understanding of the game. Indeed, many fans find the constant blasting of music distracting and annoying and may even envy the deaf for being able to focus more purely on the game.
The idea, pushed by the deaf fans in their suit, that the Redskins have 'not made FedExField fully accessible to deaf and hard of hearing fans' because they don't post song lyrics is so picayune, so petty as to drive other fans to wonder whether the motive is really to enjoy the game or merely to harass the team's owner.
More important, however, the court's ruling threatens every public performance by a sports team, musical group, theatrical troupe or any other artistic endeavor. If, as the deaf fans argue, it is 'discrimination' against them to stage a pro football game without putting the lyrics of every song up on the scoreboard, then the same reasoning would force concert halls to post lyrics as singers sing them. Would movie theaters have to erect a second screen on which to flash the lyrics of any song used in the background of a movie? Must stage companies now tear audiences' attention away from the actors by putting up screens spelling out the lyrics of incidental music, or of a song that a character might break into as part of the play?
Amazingly, Williams concluded that the deaf fans 'suffered injuries because they did not have access to music captioning and because information allegedly was not being effectively communicated to them.' As you may have noticed, left-wingers really hate to lose. Thats why, even eight years after the fact, they are still wringing their hands over the 2000 presidential election. They still insist that George W. Bush and the Republicans swiped it, even though several objective sources have since confirmed that, chads or no chads, Bush carried Florida, and that Sandra Day OConnor, otherwise a heroine to leftists, was one of the Supreme Court justices who ruled against Al Gore, the candidate who couldnt even carry his home state. Which is reason enough all of us should be forever grateful to the voters in Tennessee.
The idea that the Democrats have been crying Foul! for eight long years should appeal to everyone who appreciates irony. For it is those on the far left who have done everything in their power to corrupt the election process. One of their chief means of doing so has been through the activities of a group known as ACORN (Association of Community Organizations for Reform Now). With approximately 175,000 dues-paying members, they own TV stations, businesses and periodicals, and have offices stretching from Canada to Peru, with over 80 offices in the U.S

By Sharika Regchand One of Msunduzi Municipality deputy mayor Mervin Dirks's bodyguards was arrested on Sunday on charges of extortion, assault and kidnapping - allegedly arising from a drug deal. The man - who cannot be named because he has not yet appeared in court - was arrested along with a friend who is notorious in the Pietermaritzburg drug industry. It was said that the bodyguard and his companion had kidnapped a self-confessed drug peddler outside a Pietermaritzburg city centre nightclub, demanding that the man pay them for drugs he had supposedly sold for them. Police Superintendent Henry Budhram said the bodyguard and his ally abducted the peddler and took him to a Pietermaritzburg suburb, where they demanded payment. They had apparently given the peddler a consignment of drugs valued at R4 000 to sell. The peddler, unable to sell the drugs, had given them to another dealer to sell and had not received payment

The state wanted to use a 1.3 acre strip of Donnan's land along the river to operate a steam shovel and a dragline in order to clear the river and alleviate the flooding. Provo's Evening Herald reported that Mr. Donnan refused to let the men and machinery on his property.
Judge George W. Worthen issued a court order condemning the land for public use and authorizing men and machinery to enter the contested land. The court order prevented Donnan from interfering with the road crews in any way, since the work had already been delayed several days.
Donnan denied absolutely refusing to allow workmen on his property for any reason. He told the Herald: 'When the public employ unfair, discourteous, inefficient officials to handle public business they cannot expect courteous treatment at the hands of citizens who demand just, fair and courteous treatment.'

attorneys are political appointees who can be fired without cause, but the cases strongly suggest the attorneys were axed because they prosecuted Republicans or failed to prosecute Democrats. And what about the U.S. attorneys who got to keep their jobs? Did they bring prosecutions for political reasons?
This question looms large in the astonishing case of Don Siegelman, the former Democratic governor of Alabama who was prosecuted, convicted - and jailed - on federal corruption charges in a case brought by a U.S. attorney who is married to an ally of Karl Rove. After nine months in prison, a federal court released Siegelman pending appeal, because it found substantial questions about the fairness of the conviction.
The question of politicization of the Justice Department will not be resolved in the remaining months of the Bush administration, but the next president must not let the matter drop. Unequal justice - especially if it's infected with partisan politics - is no justice at all.

'We actually wanted $300,000,' Quesenberry said. 'It was an amazing trial.'
'If I had any comment, it would be, homeowners hang in there,' said Mark Hess on Saturday.
Hess said he and his wife 'have been battling this for four years. It took a lot of time and money. It is the kind of thing where we got no apologies even after we won and prevailed through court.'
Hess cautioned would-be homeowners.

Washington Supreme Court rules victims' job rights are protected
A deeply divided Washington Supreme Court has ruled that the jobs of victims of domestic violence, who are forced to take time off work to look out for themselves or their families, are protected.

A federal court in Michigan has ruled that consumers in that state have the right to buy wine shipped to them from out-of-state retailers.
The interstate commerce clause of the U.S. Constitution prohibits the state from blocking out-of-state retailers from selling, delivering and shipping wine directly to consumers in Michigan, Judge Denise Hood of the U.S. District Court for the Eastern District of Michigan said in the decision filed Tuesday.
The state of Michigan may continue to collect any tax due on the sale of wine and may continue to require licenses and permits for direct interstate sales and deliveries, so long as the provisions to not discriminate against out-of-state wine retailers, Hood said in the order.
The lead plaintiff in the suit was Siesta Village Market LLC, a wine retailer in Sarasota, Fla

BIRMINGHAM, Alabama: Alabama felons eligible to vote in the upcoming election haven t been able to register or had their rights stripped away because the governor s list of disqualifying crimes is overly broad, state court administratorssay.
The governor s list of 444 'crimes of moral turpitude' - which state law says are the only crimes that can disqualify citizens from voting - includes many not previously considered serious enough to cost convicted criminals their voting rights. Among those listed are animal cruelty, shoplifting and illegally setting a brushfire.

SAN DIEGO (AP) The attorneys for two Marines charged in the killing of unarmed Iraqi detainees accused prosecutors Friday of intimidation by delaying the court-martial of one to try forcing testimony from the other, who faces similar charges.
Sgt. Ryan Weemer and another Marine, Sgt. Jermaine Nelson, face military charges of unpremeditated murder and dereliction of duty in the death of a detainee during combat in Fallujah. A military judge this week granted a prosecution request to postpone Weemer's court-martial.
Weemer and Nelson have repeatedly refused to testify against each other, as well as against a former squad leader, Jose Nazario, who was acquitted in August in federal court of charges related to the killings on Nov. 9, 2004.
Weemer's attorney, Paul Hackett, said he believes prosecutors first want to court-martial Nelson, who has repeatedly invoked his Fifth Amendment right against self-incrimination, because they think they can force him to testify against Weemer if convicted.
Nelson's attorney, Joseph Low, said military prosecutors have indicated that if Nelson failed to testify, he would face obstruction of justice charges that carry a maximum five-year prison sentence.
'I don't know why that's not witness intimidation,' he said

The Alaska Supreme Court will decide whether to block the findings of an abuse-of-power investigation due to be released next week that could be potentially damaging to Governor Sarah Palin's vice presidential candidacy.
The court accepted an emergency appeal late on Friday filed by six Alaska politicians who claim the investigation is being manipulated to hurt Palin before Election Day on November 4.
The court scheduled verbal arguments for Wednesday on whether to suppress the probe's findings.
The independent investigator conducting the probe plans to turn over his conclusions by next Friday to the Legislative Council, the body that authorised it.
The six Republican politicians, who are not on the Legislative Council, filed the emergency appeal after their lawsuit was dismissed by an Anchorage judge on Thursday

MOSCOW - Russia's Supreme Court formally rehabilitated the country's last czar yesterday, declaring Nicholas II and his family were unlawfully killed by Soviet authorities.
The ruling negates the Romanovs' culpability in crimes the Bolsheviks used to justify the 1917 revolution and the slaying of the czar and many of his relatives the following year.
'The presidium declared as groundless the repression of Czar Nicholas II and his family and rehabilitated them,' said Pavel Odintsov, the Supreme Court spokesman.
The decision reverses the court's ruling of November, 2007, that the killings did not qualify as political repression, but were premeditated murder

Boston Scientific earlier in the morning said that it will appeal the decision of a judge who awarded rival Johnson & Johnson roughly $700 million in damages and interest in a patent lawsuit.
Boston Scientific added that the US District Court in Delaware has entered judgment against the company in a case involving a patent owned by Johnson & Johnson and Boston Scientific's NIR stent product.
In the judgment, the judge awarded Johnson & Johnson damages in the amount of $406,670,987 and pre-judgment interest in the amount of $296,140,867, said Boston Scientific, which noted that it hasn't sold the NIR stent since 2004.
The original lawsuit was filed in 1997, Boston Scientific said. Johnson & Johnson is based in New Jersey.

AMSTERDAM, Netherlands (AP) An appeals court on Thursday increased the prison sentences of four Islamic radicals accused of plotting attacks on Dutch politicians, convicting them of the additional charge of membership in a terrorist organization.
The Hague appeals court re-convicted the four Dutch nationals of Moroccan descent for plotting attacks, and said trial evidence showed they were part of a single group, as prosecutors had argued.
Judges cited their adherence to a single violent belief system, their training with firearms, and their coordinated efforts to find the addresses of Dutch politicians on a hit-list, including the prime minister.
The court's judges added a year to the sentence of ringleader Samir Azzouz, 22, giving him a total of nine years in prison. Azzouz had videotaped a suicide testament.

WASHINGTON -- The Supreme Court reaffirmed its June ruling that capital punishment is unconstitutional for crimes short of murder, rejecting pleas from the Bush administration and the state of Louisiana to reconsider in light of new information.
In June, the court ruled, 5 to 4, that a Louisiana statute providing the death penalty for raping a child under age 12 violated the Eighth Amendment, which bans 'cruel and unusual punishments.' The case dealt with the March 1998 rape by Patrick Kennedy of his 8-year-old stepdaughter. The aggravated-rape conviction, combined with the victim's age, resulted in a sentence of death under Louisiana's rape laws.

The claim was reportedly contained in court papers obtained by a celebrity website following Ms Stone's unsuccessful custody battle with her former husband Phil Bronstein.
The document portrayed the 50-year-old star of the Basic Instinct films as an alarmist parent who had become convinced that Roan, whom the couple adopted, suffered from a spinal condition despite there being 'no evidence' to back up her belief.
Judge Anne-Christine Massullo of San Francisco Superior Court also reportedly suggested that Ms Stone's acting commitments meant that she was often an absent parent who passed on many of her responsibilities to third parties because of her busy schedule and frequent travels.
The document, known as a Tentative Statement of Decision, set out the judge's decision to deny Ms Stone's request to have custody arrangements modified to allow her to bring the child, who lives with Mr Bronstein in San Francisco, to her home in Los Angeles.

An Iowa appeals court on Wednesday reversed the conviction of an off-duty Chicago police officer who says he hit a man in self-defense three years ago while visiting his brother in Dubuque.
Last year, a district court judge convicted Michael A. Mette for failing to avoid the 2005 scuffle. Mette served 11 months of a 5-year sentence while family members, police officers and Chicago officials, including Mayor Richard Daley, Police Supt. Jody Weis and Cook County State's Atty. Richard Devine, called for the decision to be overturned.
The Iowa Court of Appeals did just that, saying there was no evidence that Mette could have escaped the altercation. The ruling sets the stage for the officer to be released, provided the Iowa attorney general's office does not seek another appeal

A sheriff's deputy, two residents, two construction workers and a motorist were killed in the Sept. 2 shooting spree near Alger, about 70 miles north of Seattle. Most of the shootings took place in an isolated neighborhood; prosecutors allege Zamora then headed south on Interstate-5, firing as he went.
Six counts of attempted first-degree murder were also filed, involving four people wounded by gunshots or stabbing and a couple who escaped injury when a bullet shattered two windows of their vehicle on I-5. In all, prosecutors filed 20 charges in Superior Court, including weapons and burglary counts.
Zamora was also charged earlier this month in District Court. His only comment during that court appearance was to twice declare: 'I kill for God. I listen to God.'
His attorney, Keith Tyne, said at that time 'clearly there are significant mental health issues at play.' A phone message left for Tyne late Monday was not immediately returned

JERSEY CITY, N.J. - A state appeals court handed another defeat to Jersey City's handgun purchase limit Monday, and city officials said they would appeal the ruling to the state Supreme Court.
Monday's ruling affirmed a lower court decision that struck down a 2006 city ordinance that sought to limit handgun sales in the city to one per person per month.
'We will not rest until we have taken this step forward so we can make our city and our state as safe as we possibly can,' Jersey City Mayor Jerramiah Healy said Monday at a news conference at City Hall.

London, Sept 30 (ANI): German supermodel Heidi Klums hit reality TV design contest Project Runway has been stopped from moving to America''s Lifetime network by a New York judge, because of airing rights.
The airing of the sixth season of the programme was blocked when the judge issued a preliminary ruling against the Weinstein Company, which owns Lifetime.
The show has already started the production of its new season, and Lindsay Lohan has even filmed her stint as a guest judge in the series opener.
The series was expected to air on Lifetime in January next year after the network picked up the show from NBC Universal-owned Bravo.
The overwhelming evidence demonstrated that The Weinstein Company violated NBC Universals right of first refusal to future cycles of Project Runway. After hearing all of the evidence, the court issued an order prohibiting The Weinstein Company from taking the show or any spin-off to Lifetime, the Daily Express quoted a statement from NBC as reading.

EDINBURG - The trial of a nearly half-ton woman facing a murder charge in the death of her 2-year-old nephew will have to be held in a building separate from the courthouse because of the defendant's weight, her lawyer said.
The defense attorney's claim Monday is the latest challenge facing South Texas authorities in pursuing charges against Mayra Rosales, who suffers from a thyroid disease.
Rosales, whose weight has been estimated between 800 pounds and 1,000 pounds, was arrested and charged at home because the Hidalgo County sheriff's department did not have a large enough cell or a way to transport her to jail. After she was indicted for capital murder, a state district judge allowed her to skip arraignment and another court appearance because of the difficulty of getting her to the courthouse.
Her lawyer, Sergio Valdez, said at a hearing Monday that Rosales could die before trial because the government cut off medical care, believing she's in custody instead of under house arrest.
'Medicaid, disability, nursing - all that was canceled by the Department of Human Services because they contend that she's under arrest,' Valdez said, according to a story Tuesday on the San Antonio Express-News Web site.
Rosales faces a capital murder charge in the March death of her nephew, Eliseo Gonzalez Jr., who prosecutors say was hit twice in the head while being watched by his aunt

It was the second setback in a week for the administration's campaign to return management authority to state officials in the two regions where the wolf has rebounded after being driven to the brink of extinction in the lower 48 states.

The GGYC met the deadline for filing its brief with the New York State Court of Appeals in Albany. The California yacht club, which backs Larry Ellison's BMW Oracle Racing, wants the court to overturn a ruling by the New York Supreme Court's Appellate Division that Spain's Club Nautico Espanol de Vela, not GGYC, should be the Challenger of Record for the 33rd America's Cup.
This is the latest step in the 16-month spat between the GGYC and Societe Nautique de Geneve, which backs two-time defending America's Cup champion Alinghi of Switzerland.
GGYC filed its appellate brief two days after Ellison, the CEO of Oracle Corp., and Alinghi's boss, Swiss tycoon Ernesto Bertarelli, met in San Francisco in an attempt to get sailing's premier event out of legal gridlock and back on the water in its traditional format.

Hexion Specialty Chemicals Inc. has lost its fight in a Delaware court to bow out of an acquisition deal for Utah chemical maker Huntsman Corp.
A judgment entered Monday in Delaware Chancery Court rejected all allegations by Columbus-based Hexion and its New York-based parent, Apollo Management LP, that Huntsman s financial condition would render the combined company insolvent. A NSW Supreme Court trial of 10 former James Hardie officials began on Monday in a Sydney courtroom packed with asbestos victims with their friends and families.
The Australian Securities and Investments Commission (ASIC) is pursuing civil penalties against the defendants, each of whom is facing maximum penalties of $200,000 and a possible ban from managing a corporation.
Opening ASIC's case, Tony Bannon, SC, said James Hardie executives, including former chief executive Peter Macdonald, bridged their obligations by issuing statements in 2001 claiming the company was able to meet all future compensation claims.
In one example, the company issued a statement to the Australian Securities Exchange (ASX) announcing the formation of its Medical Research and Compensation Fund (MRCF), in which it claimed the foundation had 'sufficient funds to meet all legitimate compensation claims'.
Mr Bannon told the court this 'unequivocal statement' came despite advice to the company that estimating the cost of future compensation liabilities was 'fraught with difficulties'.
In a report written for James Hardie in 1998 by a consultancy firm that spent two years researching asbestos-related compensation liabilities, the company was told that 'future predictions remain difficult'

CAIRO (Reuters) - An Egyptian appeals court sentenced the outspoken editor of a local independent daily newspaper to two months in prison on Sunday and the editor said he would show up to serve the sentence.
'I've decided to turn myself in,' Ibrahim Issa, executive editor of the al-Dustour newspaper, told Reuters.
Issa was not present when the verdict was announced, according to court sources.
'I believe this ruling opens the gates of hell to Egyptian journalism. It takes us back to square one,' he said.
Issa was sentenced to six months in jail with labour in March for publishing false news about President Hosni Mubarak's health but was released pending appeal

Not so fast Lifetime.
Turns out there's a bit of a sticky wicket for the plans of the power-to-the-women cable channel to woo Project Runway away from gay-fabulous Bravo, which is owned by NBC. Project Runway is owned by Hollywood powerhouse Harvey Weinstein (Miramax co-founder; hubby of Marchesa label's Georgina Chapman; bought Halston last year).
Friday New York State Supreme Court judge Richard Lowe granted NBC/Universal an injunction that bars Weinstein from moving the franchise to Lifetime, even though the show has already started videotaping for a January debut for the sixth season (Lifetime originally planned on launching their version in November).
NBC's case seems to rest on their assertion that they had 'first right of refusal.'
Weinstein released this statement: 'We are glad that the court held that NBCU cannot exhibit the program on Bravo and that court required NBCU to post a minimum $20 million bond. Obviously we will be appealing and remain committed to our partners.'
Weinstein has always asserted that he did offer NBC the first deal and they were outbid by Lifetime.
NBC says the real problem is that Weinstein made a power-play trying to bundle a bunch of shows the network was not interested in on the basis of Project Runway's success

Firefighters went to the block of flats about 7am (AEST) after reports a fourth floor unit was alight.
Nord was pulled from his unit by firefighters, who quickly extinguished the blaze and then alerted police after discovering chemicals and explosive devices inside the premises.
Nord now faces charges of damaging property by fire and possessing explosives with the intent to destroy other properties.
He chose not to appear in Parramatta Local Court for a bail hearing.
A police statement of facts tendered to the court said Nord bought 20kg of compounds, including potassium nitrate, chlorine, and sulphur, to make home-made explosives.
He also is accused of having 31 devices suspected to be smoke bombs.
'The accused revealed the ingredients had been purchased by him over the past three months, June to September 2008, in order for him to carry out a plan to cause damage and destruction to the Coles supermarket located at Westfield Shopping Centre at Bondi Junction by setting off a smoke bomb and subsequently burning down the property,' the statement says.
In April 2005, Nord sustained facial injuries during an armed robbery while working at a Coles Express store in Edgecliff, the court was told.
He has not worked since, but has received workers' compensation while remaining on Coles' payroll

Miura to continue court battle in Saipan

Bruce Berline said he informed his client by telephone of a Los Angeles county court's decision to activate an arrest warrant for him.
Meanwhile, Miura has demanded that the decision by the district court of the U.S. Commonwealth of Northern Mariana Islands approving his transfer to Los Angeles be nullified. The attorney vowed to continue the court battle to prevent his client's extradition, saying Miura will need to appear in the district court in Saipan.

AMSTERDAM (Reuters) - Prosecutors have enough evidence to send two Congolese warlords accused of war crimes to trial but not on all charges, the International Criminal Court (ICC) said on Friday.
The ICC said in a statement there was evidence to prosecute Germain Katanga and Mathieu Ngudjolo for war crimes of attacking civilians, sexual slavery, and rape committed through other persons, and using child soldiers.
The court said there was not enough evidence to try them on other charges of crimes against humanity.
The trial chamber must now set a date for the start of the trial, but it is unlikely it will start this year, said Sonia Robla, head of public information and documentation at the ICC.
The two allied militia leaders are accused of directing an attack in 2003 on the village of Bogoro in the north eastern Congolese district of Ituri, an area long riven by conflict over its rich natural resources including gold, diamonds and oil.
Prosecutors said in June there was evidence that more than 200 children, women, elderly and civilian men were killed in an attack during which women were sexually enslaved in camps and repeatedly raped

The court ruled in favor of Linda and Megan Schunk, the wife and daughter of the late Edward Schunk of Stanley, Wis. He died from a self-inflicted shotgun wound in January 2006 while he was suffering from non-Hodgkin's Lymphoma at age 63.
Under Schunk's will, his wife and teenager daughter were to inherit 80 acres of land, a $100,000 life insurance policy, equipment from his logging company and other money. Edward Schunk also had six older children with different women who were left little or nothing in the estate, valued at $488,000 in 2006, according to court records.
Five of those children challenged the will in court, arguing his wife and daughter helped him commit suicide and therefore should be ineligible to inherit under the law.
The two admitted they drove him home from the hospital on a one-day pass the day he committed suicide but they denied assisting. The other children alleged the two knew he wanted to commit suicide, drove him to a cabin on the property, helped him inside, gave him a loaded shotgun and left

The Supreme Court will decide Monday whether it will take Davis' case. If it doesn't, he likely will be executed, despite evidence of his innocence.

A federal appeals court has upheld a lower court ruling that Microsoft need not pay damages to Alcatel-Lucent in a long-running patent dispute in a case that could have opened up a broad range of litigation over the MP3 music format.
The appeals court, in its ruling published Thursday, agreed with a lower court that Microsoft didn't infringe on one patent in question and that Alcatel-Lucent didn't have standing to sue over the other patent.
Microsoft was initially hit with a $1.5 billion verdict in the case

District Judge Michael Davis on Wednesday granted Jammie Thomas' motion for a new trial in the case, brought by the Recording Industry Association of America that alleged she illegally downloaded copywritten material off the peer to peer site Kazaa.
Additionally, the judge urged Congress to redefine the definition of peer-to-peer piracy and prevent exorbitant fines to be levied against other defendants in similar situations, according to his ruling.
Thomas was initially found guilty of downloading 24 songs and ordered her ordered to pay $222,000 to six record companies. That equates to $9,250 per downloaded song. With the order of the new trial, Davis declined to rule on the fine, instead deferring that decision to the next round of litigation.
Davis's declared the mistrial because he said he believes he misled the jury in the initial court case when he told the jury that sharing music was the same as distributing it.
In Jury Instruction 15, he instructed the jury that, 'The act of making copyrighted sound recordings available for electronic distribution on a peertopeer network, without license from the copyright owners, violates the copyright owners' exclusive right of distribution, regardless of whether actual distribution has been shown.'
On May 15, Davis first announced he was considering granting a new trial because the Court may have 'committed a manifest error of law in giving Jury Instruction No. 15.'
Davis then heard oral arguments from attorneys on both sides, with Thomas's attorney arguing that if Jury Instruction No. 15 was, indeed, an error, a new trial should be granted to avoid a miscarriage of justice. After hearing arguments from each side, Judge Davis eventually ruled that he erred in issuing the instruction and arguments were heard about the definition of the word 'distribution.'
The court eventually concluded that if 'simply making a copyrighted work available to the public constituted a distribution, even if no member of the public ever accessed that work, copyright owners would be able to make an end run around the standards for assessing contributor copyright infringement.'
Finally, Judge Davis ruled in favor of a new trial.

CHARLESTON, W.Va. (AP) West Virginia's Supreme Court has agreed to a full review of appeals arising from a nearly $400 million judgment against DuPont.
A Harrison County jury awarded the damages to residents last year, after finding the chemical giant downplayed and lied about health threats at a former zinc smelting plant in Spelter.
The high court accepted DuPont's appeal of the verdicts, and of the circuit judge's order holding it liable for the conduct of the site's previous owner.
They've been combined with an appeal from the plaintiffs, who want more people compensated for private property cleanups.

The 4-1 decision dated Wednesday and released Thursday upholds a lower court ruling that sided with Jennifer Henn and her former employer, the Times-Tribune of Scranton.
Two former Lackawanna County commissioners sued Henn and the paper over a January 2004 story that said they were not cooperative in their appearances before the grand jury.
The Supreme Court said reporters cannot be forced to identify confidential sources a protection granted by the state's Shield Law.
Grand jury proceedings are secret and state law bars prosecutors, court officials or jurors from discussing such investigations

Judges reviewing the insider trading conviction of former Qwest CEO Joe Nacchio focused Thursday on expert witnesses at Nacchio's 2007 trial.
The 10th U.S. Circuit Court of Appeals concentrated on whether Nacchio's attorneys should've tried harder to have testimony by one of their expert witnesses admitted at trial. The nine-judge panel did not immediately issue a ruling.
Nacchio was convicted last year of insider trading for selling $52 million worth of stock when prosecutors argue he knew Denver-based Qwest Communications International Inc. (nyse: Q - news - people ) was at risk while other investors did not.
